1. The promoter of Ben Shaws® Favourite Family Chippy Award 2011 is Cott Beverages Limited (Company Number 2836071) whose registered office is at Citrus Grove, Side Ley, Kegworth, Derby, DE74 2FJ trading for the purposes of this promotion under its brand name “Ben Shaws”.

2. The Ben Shaws Favourite Family Chippy Award 2011 is free to enter for all bona fide family owned and run fish and chip takeaways (in which two or more members of the same family work together, including immediate family members, like brothers and sisters, partners, married couples or civil partners, and/or extended family members such as cousins, aunts and uncles) in the United Kingdom (but excluding shops in the Channel Islands and the Isle of Man) who have access to the internet. In order to enter the competition, businesses must have been in operation for at least 18 months, as of 20th February 2011. Ben Shaws reserve the right to request at any time that any entrant provide any evidence reasonably required to enable Ben Shaws to verify compliance with the rules of this competition and Ben Shaws reserves the right to disqualify, at any time, any entrant shown to have given false information or who has failed to comply with any of the rules of this competition.

3. Only one entry is permitted for each family run chippy business. As the award is bestowed on an individual shop unit, multiple entries from different branches of the same business are not permitted – if you own more than one branch then, you should select the branch which you think stands the best chance of winning. Entries must be completed by an adult aged over the age of eighteen who has permission to enter this competition on the behalf of their business.

4. Your business must remain owned by you and your family for the entire duration of this competition. If you sell or close your business before the end of the competition so that it is no longer owned by the same family as when you entered then, you will be automatically disqualified.

5. Winners will be informed by post, telephone or email as soon as possible after the closing date of each round of the competition and, details of all winners will be available on this website. If at any stage of this competition any entrant is disqualified then, Ben Shaws shall be entitled to replace that entrant with the entrant who, in the opinion of the judging panel, submitted the next best entry.

6. All entrants will have to complete an initial self-audit form to be submitted to Ben Shaws along with a photograph of the business in question and some supporting written documentation (although the provision of a photograph is optional). It is the responsibility of the businesses to ensure that completed entries are returned to Ben Shaws in time for judging. Proof of posting or transmission will not be accepted as proof that your entry has been received by Ben Shaws. Please note that entry forms and photographs will not be returned.

7. You must ensure that you own the copyright in the photograph which may submit as part of your entry (as well as in any other information which you provide to Ben Shaws) and that everyone who appears in your photograph is happy for it to be submitted as part of your entry. Whilst you will retain ownership of all such copyright, you agree as a condition of your entry to grant Ben Shaws irrevocable, royalty free worldwide licence to use at our discretion any photographs and other information submitted by you in connection with this promotion and the promotion of the Ben Shaws brand generally.

8. Employees of Ben Shaws together with members of their immediate families are not permitted to enter this competition.

9. All qualifying first round entries will be scored by the judging panel in order to shortlist a total of three regional winners. These three short listed businesses will then be announced on this website. Visitors to the website can then vote for their favourite fish and chip shop. Subject to the voting rules, the business with the most votes by 23:59 BST on 3rd October 2011 will be crowned the overall winner.

10. The competition for first round entries runs from 00:01 BST on 20th February 2011 until 23:59 26th August 2011. Three regional winners will be selected by the judging panel and announced on this website during the week commencing 5th September 2011. Voting will take place after this announcement and up until 23:59 BST on 3rd October 2011. The winner will be announced on 7th October 2011.

11. Publicity for this competition will be organised by Ben Shaws and it is a condition of entry that your business will participate at its own cost in any reasonable publicity activities which are requested by Ben Shaws and that you adhere to any reasonable instructions or requests, which are made of you by Ben Shaws in connection with such publicity.

12. The prize for the overall winner consists of £1000 (one thousand pounds) worth of gift or experience vouchers to share among you and your family. Details of the range of gifts and experiences are available to view at www.activeconsultancy.com. The prize also consists of £1000 (one thousand pounds) cash for the winning family to donate to a registered community charity of their choice. This donation will be made via Cott Beverages Limited on behalf of the winner. In addition, the overall winner will also receive a year’s supply of Ben Shaws soft drinks equating to 48 cases of 24x330ml Ben Shaws cans of mixed variety. There is no cash alternative for any of these prizes.

13. Entry to this competition and/or winning this competition does not entitle you or your business to any rights of ownership, licence or use in or to the Ben Shaws brand. If you wish to make any use of the Ben Shaws brand for any purpose then, you must agree that with us in writing before doing so. If we do agree to grant you any such rights (which shall be at our sole discretion) then we shall have the right to withdraw our permission at any time.

14. This competition will be governed by the laws of England and Wales and any dispute will be subject to the exclusive jurisdiction of the English courts.

15. Ben Shaws reserves the right to cancel or vary this competition due to circumstances beyond its reasonable control.

16. The decision of the judges is final and binding.

17. This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. 2 ENTERING THE PRIZE DRAW

2.1 By entering into this prize draw You accept these terms and conditions and Our terms and conditions for Your use of the Website. If You don’t comply with any of these terms and conditions then We might (at Our discretion) exclude You from this prize draw or withhold the prize from You.

2.2 This prize draw isn’t open to You if You are under 18; if You live outside of the UK; if You are one of Our employees (or a family member of one of Our employees); or if You are an employee of any of Our associates, agents, affiliates, group or subsidiary companies.

2.3 Provided that You don’t fall into one of the categories set out above then You may enter this prize draw. Whilst there is no charge for entering into this prize draw, You can do so only by voting for Your favourite family chip shop via the Website. Only one entry is allowed per person and, We reserve the right to exclude You from this prize draw if You attempt to make multiple entries.

2.4 If You enter and win then We may use Your name and Your general location for publicity, whether now or in the future.

3 PRIZES AND WINNERS

3.1 For this prize draw, entry closes on 3rd October 2011 at 23:59 BST (British Summer Time). After that time, We will collect the names of everyone who has entered and draw one name out at random who will win the prize.

3.2 The prize is a Apple iPod Nano 8GB Black. Please note that there is no cash or other alternative to this prize. However, We may at Our discretion elect for whatever reason to give You a prize of equal or greater value.

3.3 If You are selected as the winner, We will contact You to let You know and where possible, We will send the prize to You within 20 working days of the draw.

4 OTHER IMPORTANT INFORMATION

4.1 Our decisions about any promotion (including this prize draw) are final and binding.
